PLEASE READ THESE TERMS CAREFULLY. By using Social Spork, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

1. Definitions

  • "Service" refers to the Social Spork website, applications, and all related services.
  • "User," "you," "your" refers to any person accessing or using the Service.
  • "Content" refers to recipes, images, text, URLs, comments, and any other material submitted to or displayed on the Service.
  • "User Content" refers to Content submitted by users.
  • "Third-Party Content" refers to Content from external sources (e.g., TikTok, Instagram, YouTube videos).

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our sole discretion.

4. Description of Service

Social Spork provides tools to extract, organize, and save recipes from various sources including social media videos, uploaded images, and user-entered text. The Service uses artificial intelligence to transcribe audio, recognize text in images, and structure recipe content.

4.1 AI-Generated Content Disclaimer

⚠️ Important Health & Safety Notice

Recipe content is extracted and processed using AI technology. While we strive for accuracy, AI-extracted recipes may contain errors including but not limited to:

  • Incorrect ingredient quantities
  • Missing ingredients (including allergens)
  • Incorrect cooking times or temperatures
  • Inaccurate nutritional information

Always verify ingredients, especially if you have food allergies, dietary restrictions, or health conditions. Social Spork is not liable for any adverse reactions, illness, or injury resulting from reliance on AI-extracted content.

5. User Content and Conduct

5.1 Your Responsibilities

You are solely responsible for any Content you submit. You represent and warrant that:

  • You own or have the necessary rights to submit the Content
  • The Content does not infringe any third party's intellectual property or other rights
  • The Content does not violate any applicable laws
  • The Content is not false, misleading, defamatory, or harmful

5.2 License Grant

By submitting Content to the Service, you grant Social Spork a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content in connection with operating and providing the Service.

For Content you mark as "private," this license is limited to providing the Service to you personally and does not include public display.

5.3 Prohibited Conduct

You agree NOT to:

  • Submit Content that infringes copyrights, trademarks, or other intellectual property rights
  • Submit URLs to content you do not have permission to access or share
  • Use the Service for any illegal purpose
  • Attempt to circumvent any security features
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Harvest or collect user information without consent
  • Upload malicious code, viruses, or harmful content
  • Use the Service to spam or send unsolicited communications
  • Attempt to reverse engineer the Service

6. Intellectual Property and Copyright

6.1 Our Intellectual Property

The Service, including its design, features, and content (excluding User Content and Third-Party Content), is owned by Social Spork and protected by copyright, trademark, and other intellectual property laws.

6.2 Third-Party Content and Creator Attribution

When you extract recipes from third-party platforms (TikTok, Instagram, YouTube, etc.), the original content remains the property of its respective creators. Social Spork:

  • Provides attribution to original creators where available
  • Links back to original source content
  • Does not claim ownership of third-party content
  • Respects creator rights and will remove content upon valid request

6.3 DMCA Copyright Policy

Social Spork respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA).

Filing a DMCA Takedown Notice

If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information in writing:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material that is claimed to be infringing, with enough detail so we can locate it (e.g., URL)
  4. Your contact information (address, telephone number, email)
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

Counter-Notification

If you believe your content was wrongly removed, you may submit a counter-notification with: (1) your signature, (2) identification of the removed material, (3) a statement under penalty of perjury that removal was a mistake, (4) your contact information, and (5) consent to jurisdiction of federal court in your district.

Repeat Infringer Policy

We will terminate accounts of users who are repeat infringers of copyright.

7. Indemnification

You agree to indemnify, defend, and hold harmless Social Spork, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any Content you submit to the Service
  • Your violation of any applicable laws or regulations

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • AI-extracted content will be accurate or complete
  • Any errors will be corrected
  • The Service is free of viruses or harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIAL SPORK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICE
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
  • ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE SERVICE
  • ANY ERRORS OR OMISSIONS IN ANY CONTENT
  • ANY CONTENT POSTED OR TRANSMITTED THROUGH THE SERVICE
  • RELIANCE ON AI-EXTRACTED RECIPE CONTENT

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

10. Dispute Resolution

10.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@social-spork.com. We'll try to resolve the dispute within 30 days.

10.2 Binding Arbitration

If we cannot resolve the dispute informally, you and Social Spork agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except that you may assert claims in small claims court if your claims qualify.

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in English, and judgment on the award may be entered in any court with jurisdiction.

10.3 Class Action Waiver

YOU AND SOCIAL SPORK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10.4 Exceptions

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for intellectual property infringement or misappropriation.

11. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using account deletion features in your settings.

Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Effective Date."

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified terms, you must stop using the Service.

14. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Social Spork regarding the Service.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
